This practice focuses largely on complex contract disputes arising out of construction agreements for private and public projects, including disputes involving the construction of hotels, office buildings, condominiums, and large multi-family residential apartment complexes.

In this position, D.R.'s practice primarily included representing owners, general contractors, subcontractors, suppliers, sureties, and other parties in the construction industry. Here, he gained experience in the prosecution and defense of all categories of claims, including bid protests, payment and performance bond claims, construction liens, concealed conditions, default terminations, delay and acceleration, and design errors and omissions.

D.R. has also negotiated construction disputes through alternative dispute resolution processes (often mediation), and when all else failed, litigated and tried cases before Federal and State Courts. He is experienced in finance and contract administration with the U.S. Department of Housing and Urban Development, including contract closings, previous participation procedures, limited denials of participation, and cost certification.

Clark Construction is one of the largest general contractors in the United States with its corporate offices in the Washington, D. C. area. Clark also has numerous subsidiaries including the Guy F. Atkinson Construction Corporation.

At this company, D.R. was responsible for all legal matters in the Mid-Atlantic Region, including negotiating owner contracts and subcontracts, managing litigation, and resolving claims with owners and subcontractors. During this time, he also consulted with and provided solutions to executives and project management in resolving day to day project problems.

As Assistant General Counsel, D.R. was also responsible for all construction and development related transactions, including lender agreements, settlement agreements, escrow agreements, leases, guarantees, indemnity agreements, and assignments. He handled certain transactions for affiliated Clark organizations including purchase agreements and closings of commercial property in downtown Washington, D. C. His responsibilities also included supervising, training, and evaluating legal department staff.

While in this role, he was active in business develop and bidding new projects, while also supervising and managing jobsite foremen and laborers.

Meet D.R. Repass

A native Floridian and grandson of the late Judge D.R. Smith, D.R. Repass grew up in the small town of Ocala, where he spent his days on his grandfather's cattle farm. There, he learned the pleasure of hard work and the importance of having integrity, being respectful to those around him, and becoming a leader.

When he's not helping clients, D.R. spends time with his three children and wife Kasey, who has a masters degree in taxation from the University of Florida. In his spare time, he also enjoys fishing, hunting, and spending time outdoors.
